Residence permit refused in Türkiye: 10 days to leave, appeal and re-application

A refusal of a residence permit application or renewal (ikamet izni ret kararı) is an administrative decision of the Presidency of Migration Management. It has a notification date, and every deadline runs from it: 10 days to leave Türkiye if you have no other lawful basis to stay, and 60 days to file an annulment lawsuit at the administrative court. Between the two there is a third route: an objection to the Directorate itself and a corrected re-application. Below: how to read the decision, why applications are refused most often in 2026, and which of the three routes to take.

What a ret kararı is and where the clocks start

The refusal is issued by the Provincial Directorate of Migration Management (İl Göç İdaresi Müdürlüğü) under Law No. 6458 on Foreigners and International Protection. It states the ground (usually a reference to an article of the law), the date, and how you were notified. Notification can come in several forms: a status change on e-ikamet, a letter to your address, hand delivery against signature, or electronic notification. All deadlines run from the notification date (tebliğ tarihi), not from the decision date — check it on the document itself and keep the envelope or a screenshot.

If you were waiting for a renewal decision, your previous permit counted as valid until notification. After notification it ends, and the 10-day exit period starts.

The 10 days in practice

A foreigner whose application is refused is given 10 days to leave Türkiye unless there is another lawful basis to stay (a valid visa or visa-free period, another permit type, a work permit). This is not a mini-permit; it is an exit window. Staying longer puts you under the overstay rules: a fine at departure, the risk of a removal decision (sınır dışı etme kararı) and an entry ban.

  • Leaving in time is the safest option: it keeps the door open to return on a visa or visa-free and apply again.
  • Filing a lawsuit or an objection does not by itself extend your right to stay. If you want to remain during the dispute, your lawyer asks the court for a stay of execution (yürütmenin durdurulması); until the court rules, the exit obligation stands.
  • Keep your boarding pass and exit stamp: they prove you complied with the deadline.

Why applications are refused most often in 2026

Across provincial directorates and published court decisions, refusals fall into a few groups:

  • Address. A flat in a district or neighbourhood closed to new foreign registrations; a lease without notarisation; an address that does not match the address registry (MERNİS / Adres Kayıt Sistemi); an owner who did not confirm the tenancy.
  • Money. Statements that show no regular income or not enough for the whole period, cash deposited the day before filing, source of funds unexplained.
  • Insurance. A policy that does not cover the full requested period, does not meet the coverage limits, or is issued to someone else.
  • Purpose. A tourist permit requested where the directorate expects another type (study, work, family, property); a purpose not supported by documents.
  • Procedure. Missed appointment (randevu), wrong data in the e-ikamet form, missing documents not supplied in time, a passport with too little validity left.
  • History. A previous overstay, an unpaid fine, an entry ban, inconsistencies between statements in different files.

The ground is always written in the decision. If the wording is generic (“documents do not meet the conditions”), ask the directorate which item failed — that decides what to fix.

Boundaries. ROSTU does not represent you in court or before the Migration Directorate, gives no legal opinions and does not influence decisions. We prepare documents, translations and the re-application file; the objection and the lawsuit are run by a lawyer you retain yourself. Count the 10 and 60 days from the notification date on your own document.

Three routes: objection, lawsuit, new application

1. Objection to the Migration Directorate (itiraz). An administrative request under Article 11 of Law No. 2577 on Administrative Procedure (İYUK): you ask the authority to reconsider its own decision and attach the missing or corrected documents. It must be filed within the 60-day lawsuit period and stops that clock; if the authority does not reply within the statutory period, the request counts as rejected and the remaining lawsuit time resumes. Suitable when the refusal comes from a formal error or an incomplete file.

2. Annulment lawsuit (iptal davası). Filed at the administrative court (İdare Mahkemesi) of the place of the directorate that issued the decision, within 60 days of notification. The deadline is final: after it, the case will not be heard. A stay of execution is requested together with the claim. A lawyer you retain directly runs the case; it is usually decided on the documents and can take months. Suitable when you believe the refusal is unfounded and this permit type matters.

3. New application. A corrected application for the same or another permit type. If the ground is fixable (another address, full insurance, explained source of funds), this is often faster than court. You can file from inside Türkiye within your lawful stay, or from abroad after entering on a visa. Practice on repeat applications with identical grounds is strict: without new circumstances the answer repeats, and some directorates restrict repeat applications for the same type — read the text of your decision.

How to re-apply so the file passes

  1. Translate and read the decision. The exact article and wording of the refusal is the list of what must change.
  2. Close the ground with documents. A new notarised lease with the owner’s confirmation; a bank statement with a history of income, not a one-off deposit; insurance for the whole period with the right limits; documents proving the stated purpose.
  3. Check the address first. Address registration (address certificate via e-Devlet) and no restriction on the neighbourhood save months.
  4. Assemble the file in the order the officer reads it: form, passport and translations, address, money, insurance, purpose, photos, receipts for the duty and the card. Translations by a sworn translator, notarised where required.
  5. File without contradictions. Data in e-ikamet, the lease, the statement and the policy must match letter for letter: name, address, dates.
  6. Attend the appointment with the complete set and keep the filing confirmation.

We prepare that file, translate the decision and the documents, book the appointment and come with a sworn interpreter. You submit the application; the Directorate decides, and nobody can guarantee the outcome. A lawsuit needs a lawyer — you retain one directly and we hand over the prepared dossier.

Questions

Can I stay in Türkiye if I have filed a lawsuit?

The lawsuit itself gives no right to stay. You need a court order staying execution (yürütmenin durdurulması); until then the 10-day exit period applies. Discuss this with a lawyer before the 10 days end.

What happens if I do not leave within 10 days?

Your stay becomes unlawful: an overstay fine is charged at departure, and a removal decision and an entry ban are possible, with a length depending on the overstay. This complicates any new application.

How soon can I apply again after a refusal?

The law does not forbid a new application, but without new circumstances the result repeats, and for the same permit type the directorate may restrict repeat applications — see the text of your decision. From abroad you apply after entering on a visa or visa-free; from inside Türkiye within your lawful stay.

Is the fee refunded after a refusal?

As a rule the duty (harç) and card fee are not refunded on refusal; a new application is paid again. The exact terms are on the payment notice of your application.

Does changing the permit type help?

Often yes: if your real purpose is different (study, work, family, property), applying for the matching type with supporting documents does better than repeating a tourist request.
